What is a section 5(5A) notice?
A Section 5A Notice provides qualifying tenants (leaseholders) with their Right of First Refusal offer to purchase the freehold of their building when the landlord intends to sell the freehold. There is a legal obligation on landlords to serve the notice to purchase the freehold on leaseholders before they sell on the open market.
The notice must be served in accordance with the terms of the tenancy agreement to be valid. The notice does not expire and a tenant must vacate the property by the date specified in the notice.
